A Look at Fraudulent Conveyance Laws, the Uniform Voidable Transactions Act, and the Interplay of State Laws with Bankruptcy Code Section 549

In 2014, the Uniform Law Commission completed the Uniform Voidable Transactions Act (“UVTA”) which is intended to strengthen creditor protections by providing remedies for certain transactions by a debtor that are unfair to the debtor’s creditors. To date, only 22 states have adopted the UVTA and two states have bills pending to adopt same. The Uniform Fraudulent Transfer Act was adopted in 45 states with some states maintaining their own form of fraudulent transfer/conveyance laws. The U.S. Bankruptcy Code Section 548 gives a trustee the authority to avoid fraudulent transfers made within two years prior to a bankruptcy filing. This program will focus on cases from various courts which have opined on what is or is not fraudulent and the panel will discuss the changes which have been brought by the UVTA. There will also be a discussion about cases when there is a juxtaposition of the State Laws and bankruptcy laws.

N.L.P. is a method of connecting how we think, communicate, and create patterns of behavior in order to achieve an outcome. N.L.P. offers numerous amounts of applicable techniques for gaining rapport, establishing communication, and gaining trust. In this seminar you will learn to gain rapport and establish trust through sensory acuity (visual, auditory, and kinesthetic), eye clues, verbal cues, body language, and emotional matching. You will be able to identify a person’s meta program through eliciting values (away or towards mindset). You will learn the specific techniques of anchoring, reframing, tag questions, pacing and leading, “feel, felt, found,” embedded commands and forward pacing that you can apply in negotiations. Each person will receive a N.L.P. journal and will be given the opportunity to practice N.L.P. with each other during the seminar.
